Glossary of Legal Terms & Phrases

What follows is a list of various legal terms used by solicitors. This list is obviously not complete but offers an example of some commonly used phrases:

Advocacy
Legal representation in a hearing, usually conducted by a solicitor.

Beneficiary
A named person in a will entitled to receive a bequest.

Damages
The payment of Compensation to the winning party by the losing party in a case of litigation.

Executor
A person named in a will who is given responsibilty of administering the estate belonging to the deceased individual in addition to a distribution of assets.

Fraud
Acts of a dishonest nature included in Theft legislation.

Injunction
An courts order stating that an individual must carry out specific instructions.

Insolvency
An inability to settle debts owed.

Litigation
The threat of proceedings at court.

Libel
The publication of material about another person that untrue resulting in damage.

Mediation
A neutral third party being appointed to mediate and attempt to agree a settlement of two disputing parties without the need for court involvment.

Probate
Obtaining legal authority to deal with the affairs of a deseased individual.
